AI Transparency Notice

1. Overview
Eigentum² uses artificial intelligence (AI) in certain features of the platform. This notice provides transparency about which features use AI, how AI is employed, what data is processed, and what limitations apply, in accordance with the EU AI Act (Regulation (EU) 2024/1689, Article 50) and the General Data Protection Regulation (GDPR).
We are committed to the responsible and transparent use of AI. All AI features on our platform are designed as informational tools that assist users — they do not make autonomous decisions or produce legally binding outcomes.
2. AI-Powered Features
2.1 Property Valuations
What it does: When you request a property valuation, our platform uses AI to analyse the property's characteristics, location, market context, and comparable properties to generate an estimated value range.
AI provider: OpenAI, Inc. (USA), via their API. OpenAI processes data per API request and does not use your data for model training under their API terms of service.
What data is sent to the AI provider:
- Property characteristics (type, size, condition, year built)
- Property address and geographic location
- Market context and comparable property data
- The language of your request
What the AI generates:
- An estimated property value range (low to high)
- A confidence score
- Comparable property analyses
- Market context and trend information
How the output is used: The AI-generated valuation is presented as an informational estimate only. It is clearly labelled as AI-generated in the user interface. It does not constitute a certified appraisal, legal advice, financial advice, or investment recommendation. You should not rely solely on AI-generated valuations for financial, legal, or investment decisions.
Human oversight: You have full control over whether to use, disregard, or request a new AI valuation. No binding decisions are made based on AI output without your explicit action.
2.2 Legal Document Change Summaries
What it does: When administrators create a new version of a legal document (e.g., Privacy Policy, Terms of Service), an optional AI feature can generate a summary of what changed compared to the previous version.
AI provider: OpenAI, Inc. (USA), via their API.
What data is sent to the AI provider:
- The text of the previous published version of the document
- The text of the current draft version
- The language/locale of the document
What the AI generates:
- A concise, user-facing summary of the changes between versions
How the output is used: The AI-generated summary is presented as a draft for the administrator to review and edit before publishing. It is never published automatically. The administrator has full editorial control.
3. What AI Is Not Used For
We do not use AI for:
- Automated decision-making that produces legal effects or similarly significantly affects you (Article 22 GDPR)
- Credit scoring or creditworthiness assessment
- Tenant screening, selection, or rejection
- Profiling of individuals
- Emotion recognition or biometric categorisation
- Generating synthetic images, audio, or video (deepfakes)
- Surveillance or monitoring of individuals
- Automated content moderation or filtering of user data
4. Your Rights Regarding AI Processing
4.1 Right to Information
You have the right to know when AI is being used. All AI-generated content on our platform is clearly labelled as such.
4.2 Right to Human Review
You may disregard any AI-generated output and make your own assessment. For property valuations, the AI estimate is one data point — you are encouraged to consult qualified professionals (surveyors, appraisers, real estate agents) for important financial decisions.
4.3 Data Protection Rights
The processing of your data by AI features is subject to our Privacy Policy. You have all rights under the GDPR, including the right of access, rectification, erasure, and the right to object to processing based on legitimate interests.
4.4 No Automated Individual Decision-Making
We do not make decisions based solely on automated processing (including profiling) that produce legal effects or similarly significantly affect you. AI outputs are always informational and require your active decision to act upon them.

OpenAI processes data solely for the purpose of generating the requested output. Under OpenAI's API terms, data submitted via the API is not used to train or improve their models.

6. Limitations and Disclaimers
6.1 AI Estimates Are Not Certified Appraisals
AI-generated property valuations are statistical estimates based on available market data. They may differ significantly from certified appraisals, official tax assessments, or actual transaction prices. Factors not captured by the AI model (e.g., interior condition, renovations, local market micro-trends, legal encumbrances) may materially affect actual property values.
6.2 AI Outputs May Contain Errors
AI models can produce inaccurate, incomplete, or inconsistent results. We do not guarantee the accuracy, completeness, or reliability of any AI-generated output. You are responsible for verifying AI outputs before relying on them.
6.3 No Liability for AI Outputs
Our liability for AI-generated outputs is governed by the liability provisions in our Terms of Service. AI valuations are provided "as informational estimates only" and do not give rise to any warranty, guarantee, or advisory obligation.
7. Legal Framework
This AI Transparency Notice is provided in accordance with:
- EU AI Act (Regulation (EU) 2024/1689), in particular Article 50 — transparency obligations for limited-risk AI systems
- GDPR (Regulation (EU) 2016/679), in particular Articles 13-14 (information obligations) and Article 22 (automated individual decision-making)
- BDSG (Bundesdatenschutzgesetz), § 37 — additional restrictions on automated decision-making
8. Changes to This Notice
We will update this notice when we introduce new AI features or make significant changes to existing ones. Material changes will be communicated through the platform.
